Terms and Conditions
1. Scope
(1) These terms and conditions apply to contracts between the service provider and its clients, unless otherwise expressly agreed or legally required.
(2) The client's general terms and conditions are only binding for the service provider if he has expressly recognised them.
2. Scope of services
The service shall be performed with due care in accordance with the principles of proper professional practice. The client shall receive the contractually agreed version of the service.
3. The client's duty to cooperate and provide information
(1) The client must inform the service provider in good time of any special forms of service provision (translation on data carriers, readiness for printing, external form of the translation, interpreting in the booth or consecutive, chuchotage, language combinations, necessary technical equipment, recordings, special course conditions, course participants, etc.).
(2) The client shall provide the service provider with the information and documents necessary for the provision of the service (client glossaries, drawings, tables, abbreviations, conference documents, conference schedule, agenda, etc.) in a timely manner and without being asked.
(3) The service provider shall not be held responsible for errors resulting from the non-compliance with these obligations. Important to note when renting our interpreting equipment:
EUR 180.00 ex VAT will be charged for each missing or damaged receiver.
EUR 18.00 ex VAT will be charged for each missing or damaged headset. The customer is responsible for distributing and collecting the receivers and headsets! The customer is liable for any damage or loss!
(4) Sound recordings of the interpreting: If the translation/interpretation is to be recorded, it is the client's responsibility to communicate this in good time. Fees will be charged for the further use of these recordings. A distinction is made here between internal use, publication, e.g. on the internet, and the duration of use.
4. Correction of errors
(1) The service provider reserves the right to rectify any defects. The client is entitled to have any defects in the service remedied. The client must assert the claim for rectification of defects, stating the exact nature of the defect. In the event of failure of the rectification or a replacement delivery, the statutory warranty rights shall apply again, unless otherwise agreed.
IMPORTANT: Complaints about the invoice or complaints regarding the service must be made within 10 days. Complaints made at a later date will NOT be considered.
5. Liability
The service provider is liable for gross negligence and intent. Liability for slight negligence only applies if essential contractual obligations are violated. The service provider is obliged to maintain confidentiality regarding all facts that come to her knowledge in connection with her work for the client.
6. Remuneration
(1) Payment is due immediately after acceptance or completion of the service provided, unless otherwise expressly agreed and confirmed by the service provider.
(2) In addition to the agreed fee, the service provider is entitled to reimbursement of the expenses actually incurred and agreed with the client. Value added tax will be charged additionally, as required by law.
The translator is entitled to demand an advance payment for extensive translation/interpreting assignments if this is objectively necessary for the provision of the service. In justified cases, she is entitled to make the delivery of her work dependent on the advance payment of her full fee.
7. Cancellation fee
If the client cancels a translation/interpreting job assigned to QualityTranslation, the services provided up to this point in time and the expenses already incurred shall be reimbursed. In the event of cancellation of interpreting assignments, the customer shall in principle pay 50% of the agreed fee. If the cancellation occurs up to 14 days before the date of the assignment, 80% of the agreed fee shall be payable. If the cancellation occurs up to three days before the date of the assignment, 100% of the agreed fee shall be payable.
8. Place of Jurisdiction and Applicable Law
The contractual relationship is subject to Austrian law. The court of jurisdiction for all disputes arising from the contractual relationship is agreed to be the court in Graz.
